How Far Would You Be Willing to Drive If It Meant Avoiding Airport Security? [Just Me?]

The TSA is quickly becoming America's most hated agency (you're welcome meter maids) and for damn good reason—stealing from veterans, hassling kids, hassling handicapped kids, and stealing from everybody else. They've become a greater threat than whatever they're supposed to be protecting us from. More »

Steam for Linux is coming, and after waiting epochs what's a few more months?

It's been a long-running saga as to when Linux users will finally see some gaming action on Steam, but according to Phoronix that happy day should arrive within "months." Valve has been busily hiring Linux OpenGL boffins, including people recommended by Phoronix's founder, Michael Larabel, who certainly seems to be on the inside track. His photo above offers some proof of progress: it shows Left 4 Dead 2 running natively on Ubuntu 11.10 with AMD Catalysts drivers. Why has it taken so long since news of a Linux client was first floated (and officially denied) back in 2010? Larabel attributes it to Valve's "flat management structure" that allows its developers to work on what they want. (And you still question the importance of hierarchy?)

Battle Of The Boy Bands Launches On MTV!

One Direction, 'NSYNC, Boyz II Men just a few who'll duke it out for MTV's coveted title of Greatest Boy Band of All Time. Voting begins Monday!
By Christina Garibaldi

MTV News' Battle of the Boy Bands

Given the undeniable popularity of British bands One Direction and the Wanted, it's safe to say that boy bands are back, and we couldn't be more thrilled! In celebration of their triumphant return, MTV News decided to pose the question: Who's the greatest boy band of all time?

Sounds impossible, right? Well, you, the fans, are going to help us answer that question as we officially kick off our Battle of the Boy Bands! Beginning on Monday, April 23, 32 groups — they span several decades and have all released music Stateside — will battle it out in our interactive bracket to determine the big winner.

The first round of voting kicks off on Monday and ends on Thursday, April 26, when 32 bands will be narrowed down to 16. You can help your favorite band advance to the second round by voting as many times as you wish and by spreading the message on Twitter using the hashtag #BBB.

But you won't be the only ones fighting for your favorite band. The groups will be soliciting your votes with their own campaign videos urging fans to grant them the title of Greatest Boy Band of All Time.

Will newcomers the Wanted and One Direction make it to the finals? Or will veteran acts like the Backstreet Boys, 'NSYNC and New Kids on the Block stake their claim as the ultimate boy band? Do they even stand a chance against the first-ever U.K. boy-band sensations, the Beatles?

It's up to you to decide.

Find out if your favorite band made the bracket on Monday and to cast your votes early and often. The winner of the Battle of the Boy Bands will be announced Monday, May 7, so be sure to check back with MTV News for daily updates as we narrow the pool of 32 to a final champion.

Voting in round one of MTV's Battle of the Boy Bands begins Monday, April 23, at 7 a.m. ET and runs until noon ET on Thursday, April 26. Winners are determined by fan votes, so if your favorite band made the cut, make sure you keep voting. Spread the word on Twitter using the hashtag #BBB and like us on Facebook for updates!

HTC One V review

It's our definitive review of the HTC One V - the third in the new HTC One line of Android smartphones

HTC One V

HTC’s One series is all about hero devices. The One X is the all-singing, all-dancing flagship phone, while the One S delivers formidable specs in a smaller, sleeker form factor. And at entry level, there’s the HTC One V, a hero device for the mainstream market, which resurrects one of HTC’s iconic designs of old. Yep, it’s an updated version of the venerable HTC Legend, complete with aluminum construction and that famous protruding chin.

That such a product is now considered entry-level, and priced as such, is a testament to the blistering pace at which smartphone technology is developing. The One V brings respectable hardware internals together with Android 4.0 and Sense 4.0, creating a smartphone that just over a year ago would’ve been considered a high-end device.

So join us after the break to see how HTC’s mainstream champion holds up, in our full review of the One V.

The Good

A solid entry-level handset with great build quality. Delivers a decent screen and good battery life, along with the latest version of Android. Excellent camera for a basic, less expensive smartphone.

The Bad

Tiny internal storage, no removable battery. Software seems artificially limited in places. Starting price is a little too high for our liking.

Conclusion

The HTC One V isn’t going to blow your head off with bleeding-edge hardware or full-featured software, but if you want a basic Android experience without breaking the bank, it's a dependable all-rounder with one or two outstanding features.

Fresh Technology Real Estate Marketing | welcome to nwactc.net

Want to trade a subscriber base that?s been challenging to market? Market that with a virtual excursion. You may well be amazed because when reasonably priced it can be and how effortless it can be to do. The thought is straightforward; distribute photographs of the item listings to your sponsor website along with string the photos within the buy you want these to appear. Then get agents along with leads visit his or her computer systems and click on backlinks that talk about the excursions. Occasionally the readers should be able to manipulate the excursion considerably like they will the DVD person.

Stepping Outside of the Box

Internet advertising and marketing has morphed directly into articles based Real estate agent internet sites, sequential email autoresponders, newsletters and the like. Following are some opinion of every single.

1. Real estate agent Websites. If you aren?t on the internet which has a website you?re significantly powering the days. Millions of individuals visit the Internet every single day, searching for companies.

Some are seeking services that you just provide ? Real Estate Marketing. Of course, they don?t uncover a person if you don?t have a website and when you are actually experiencing one they could not uncover a person if it is poorly enhanced. So, let me give you a hand. Snap beyond. Possibly get a website that generates sales opportunities, or even overlook getting one whatsoever.

2. Sequential Email responder. Auto responders tend to be highly effective e-mail marketing plans that speed up a lot of the email chores. They carry out what are the brand implies ? which is routinely answer needs pertaining to info.

The idea in it is usually to provide totally free info to acquire someone?s email address contact information. Once it is after that you can provide followup mail messages once and for all, whilst lightly nudging these people in the direction of the most wanted response. Occasionally essentially the most wished response could possibly be so they can contact you to produce a meeting to view a home, even though maybe it may be to list out a home with you. Whatever it is sequential email autoresponders can not be beat pertaining to efficiency along with performance.

3. Newsletters. Some agents are still snail sending newsletters and at 41 cents the crop up his or her sending expenditures by yourself would certainly add up to $205.Double zero inside shipping. Now, assess that in order to zero cost inside shipping when they would email exactly the same document.

That?s proper ? mailing exactly the same facts are totally free. So, the reason why usually are not far more agents performing it?

In component the reason is that they don?t really understand the technologies, that actually isn?t really everything that difficult to understand. Additionally, like most people they may be slow in order to embrace modify. Nevertheless quote ? agents that have embraced we?ve got the technology tend to be digging out a big part of the net Real Estate Marketing activity at the worth of agents quite happy with attempting to conserve the status quo.

Football-related catastrophic brain injuries on the rise

ScienceDaily (Apr. 16, 2012) ? Catastrophic brain injuries associated with full-contact football appear to be rising, especially among high school students, according to a new report.

The increase is alarming and indicates more coaches and athletic trainers should change how they teach the fundamental skills of the game, according to researchers based at the University of North Carolina at Chapel Hill.

Until recently, the number of football-related brain injuries with permanent disability in high school had remained in the single digits since 1984. However, the tally rose to 10 injuries in 2008 and 2009, and there were 13 in 2011, according to the latest catastrophic football injury research annual report from the UNC-based National Center for Catastrophic Sports Injury Research.

"These 2011 numbers are the highest since we began collecting catastrophic brain injury data," said Fred Mueller, Ph.D., the report's lead author, director of the center and professor emeritus of exercise and sports science in the College of Arts and Sciences. "This is a major problem."

About 4.2 million football players compete nationwide, including 1.1 million high schoolers.

The center has collected data and published annual reports on catastrophic football injuries, including fatalities, disabilities and serious injuries, for 48 years. The National Collegiate Athletic Association, National Federation of State High School Associations and the American Football Coaches Association fund the research.

The center's work is believed to be directly responsible for nearly eliminating football fatalities, as well as drastically reducing the number of cervical cord injuries to single digits, between the late 1960s and the early 1990s.

Since 1977, about 67 percent of football-related catastrophic injuries have been suffered by players as they made tackles. Mueller said part of the problem is that despite being prohibited in 1976, head-to-head contact -- such as butt-blocking, face tackling or spearing tackles -- is still occurring. These strategies make the head the initial and primary contact point with an opposing player, and often lead to cervical spine fractures or permanent brain injuries.

Some players recover fully after surgery and rehabilitation following injuries. However, many only recover partially, living with paralysis or mental deficiency, relying on intensive lifetime medical care. Since 1984, there have been 488 cervical cord and cerebral injuries with incomplete recovery, including 164 brain injuries, of which 148 were among high schoolers. Additionally, the years between 2001 to 2010 saw a 25 percent jump in football-related disability brain injuries over the previous decade, increasing to 66 from 52 incidents among all types of players.

Other potential reasons for the apparent increase in brain injuries may be because of heightened awareness of the issue. Also, this year's report updated the number of football participants. However, Mueller noted that neither of these factors likely influenced the overall figures, since the report's definition of catastrophic injuries (defined as injuries that resulted in brain or spinal cord injury or skull or spine fracture, which involved some disability at the time of the accident) and data collection methods have remained unchanged.

Mueller said reversing the trend required several changes, which some in the football community are already implementing. Coaches must be well versed in the signs and symptoms of concussions, such as headaches, dizziness, nausea and light sensitivity, and pull players from games if they exhibit those indicators. Players should not return to play until cleared by a physician. Teams also should hold pre-season meetings to discuss concussions, conduct medical evaluations of all players and emphasize that the head should not be used in tackling or blocking.

The report's recommendations also note that schools should hire coaches who teach proper fundamental skills, and retain athletic trainers certified by the National Athletic Trainers' Association. Referees must be vigilant about throwing flags when they see illegal tackles and parents also must be involved in meetings and discussions about concussions.

"All of these measures are important if we want to continue to make a positive impact on the game," he said. "We have to continue research in this area. Accurate data not only indicate problem spots, but they also help us offer appropriate precautions and reveal the adequacy of our preventive measures."

The report's co-author is Dr. Robert C. Cantu, chair of surgery and chief of neurological service at Emerson Hospital in Concord, Mass.

Susan Fogwell: A Pizza-Making Class At Pizza A Casa In NYC

Now you can learn how to make your own perfect, piping hot pizza at Pizza a Casa Pizza School in Manhattan. Mark Bello, owner and preeminent pizza-maker, teaches how-to classes at his pie-making business on Grand Street.

Students jump right in making dough for light and crispy four-inch crusts. A menu is provided, and students choose from a dozen pizza combinations. This is when camaraderie and creativity ignites and top-shelf choices are decided upon from the toppings bar. Think traditional, over-the-top or never-considered toppings and you'll undoubtedly turn out a dough-spinning wheel like no other.

For sweet tooth students, there's a topping combination that sounds more like dessert with drizzled chocolate over bananas. Of course, there's a bit of student strategic planning; everyone wants to come up with their own unique, far-out pizza.

Bello, a native New Yorker, dabbled in pizza taste tests in Chicago, but deep dish wasn't his style. So back in NYC, he started a pizza lab. In a garden roof, Bello grew over a dozen varieties of heirloom tomatoes along with basil. He then started teaching at various locations in NYC until he opened his own Pizza a Casa.

When you walk in Pizza a Casa's entrance, you'll undoubtedly peruse the pizza-making tools, before making a beeline toward the back of the store for the four-hour pizza immersion class. Bello has added pasta-making classes, too.

Be sure to wear clothes which look good with a sprinkling of flour here and there. By the time you leave, you'll be proficient in making a pie in your home oven.

Classes are offered to individuals, couples and groups.

PIZZA WORKSHOP SCHEDULE

Google's revenue up 24 percent over 2011; stock split announced

Google

Google this afternoon released its first-quarter 2012 earnings results. And as you can imagine, there are a lot of zeros in them. Specifically, revenue was at $10.65 billion for Q1 2012, 24 percent higher than in Q1 2011. Cash on hand at the end of March was $49.3 billion, and Google added about 600 jobs in Q1.

Additionally, Google announced what essentially is a stock split, creating a new class of non-voting capital stock that will be awarded via a dividend to existing stockholders in a one-to-one manner.

We'll be listening in on the conference call in a few minutes to see if there's any Android-specific news.

Dolphins doomed? They're sure taking a hit

Several mass deaths of dolphins have occurred over the past few years and while experts are worried about the die-off they say we are not witnessing a global population crash.

But what is behind the recent mass strandings and deaths is complicated and, inevitably, involves humans.

For example, the bottlenose dolphin die-off in Gulf of Mexico started in early 2010, even before BP's massive oil spill in April 2010. Disease was linked to some of the hundreds of Gulf dolphin deaths, but not all of them. The ultimate cause remains mysterious.

"There is no evidence at this time to indicate that such a worldwide, multi-species crash is occurring," Randall Wells, director of the Sarasota Dolphin Research Program said. ?The large-scale mortality events and mass strandings that have made the news in the past two years appear to be unrelated.?

Nonetheless, the past two years have been rough for several species of dolphins, but not all of the nearly 40 species of dolphins are in hot water.

NEWS: Thousands of Dolphins Dying in Gulf Waters

?There is not a large-scale die-off of dolphins across the globe or throughout ocean basins,? said Connie Barclay, spokesperson for the National Oceanic and Atmospheric Administration (NOAA)'s National Marine Fisheries Service.

?What we do see are localized areas where strandings and deaths have increased,? Barcaly said. "Scientists have seen unusually high rates of illness and death in specific populations of bottlenose dolphins in the Gulf of Mexico, long-beaked common dolphins along the beaches of Peru and short-beaked common dolphins along the shores of Cape Cod."

And only certain populations of the effected species have been hit hard.

?While bottlenose dolphins in the northern Gulf of Mexico are dying at higher-than-average rates, elsewhere in the Gulf of Mexico bottlenose dolphin populations are doing fine,? Wells, a former chair of NOAA's Working Group on Marine Mammal Unusual Mortality Events , said.

One population that suffered a serious dolphin disaster swam in the Pacific off the coast of Peru. Discovery News recently reported on the thousands of dolphin corpses washing up on the tropical beaches.

?The Peru mass stranding is the largest ever reported in the (Western Hemisphere) and the biggest since the mass stranding in Europe during the '90s,? Carlos Yaipen-Llanos, president and science director forOrganization for Research and Conservation of Aquatic Animals (ORCA).

The causes of the dolphin strandings and deaths seem to be varied as well. Unlike the fungus decimating multiple North American bat species, no single reason has been found for the dolphins' dilemma.

?No common infectious disease has been identified in any of the current dolphin stranding events,? said Barclay. ?Scientists are still working to understand the local and global effects of changing environmental conditions on marine mammal populations.?

When these mass deaths occur, whole family groups can be wiped out, said Yaipen-Llanos. The effect on the future of the species when whole generations of dolphins are wiped out is a serious concern to dolphin research and conservationists.

Ocean-going dolphins are not the only ones suffering. The Chinese river dolphin, or baiji, was declared functionally extinct in 2006 after a study couldn't find a single individual.

The baiji was probably done in by a combination of problems caused by humans, including accidental deaths by getting trapped in fishing gear, vessel strikes, underwater explosions, excessive noise and depletion of prey species, according to Tim Ragen, executive director of the U.S. Marine Mammal Commission.

?Broadly similar threats face marine dolphins,? said Ragen.

Other possible accomplices in the dolphins' demise were abnormal weather, toxic algae blooms, parasites, pollution exposure, loss of prey leading to starvation, disorientation due to loud noises from ships and oil exploration and physical injury.

?In many cases, the cause of stranding is unknown and difficult to discern,? said Barclay.

What isn't in doubt is that human impacts on the ocean are hurting dolphins around the world.

?People should recognize that the dolphins need the waters to survive ? that we are visitors to their homes,? said Wells. ?As visitors, we should be good stewards, and respect the needs of these animals as they try to make a living in the aquatic environment.?

Everyday choices can affect the fate of the dolphins. Dolphin experts have some suggestions for how to lead a dolphin-friendly life.

?No matter where you live, reducing pollution can help these animals, as chemicals such as PCBs can be transported by air for thousands of miles before being deposited into the marine environment,? said Wells.

?When voting or otherwise participating in the political process, insist on transparent and environmentally responsible decision-making,? said Ragen. ?Inform your political leaders that you support fisheries and other human activities in the marine environment that are seeking to minimize their impacts and promote better ecosystem health, such as reductions or elimination of gillnet fisheries with bycatch problems.?

Ragen noted that reducing consumption in general is good for dolphins and other sea life. A major cause of habitat degradation is the increasing volume of shipping traffic which fills the sea with the thunder of engines and churning water.

?The overall picture for dolphins and other marine and aquatic wildlife is not very promising ? witness the massive over-exploitation of fish stocks, the huge expansion of larger, faster and louder ships, the rush to develop offshore oil and gas, and the apparently intractable problems of climate disruption and ocean acidification,? Ragen said.

Syria demands guarantees before pullout from cities

Syria on Sunday demanded guarantees that armed groups cease fire before withdrawing its troops from protest hubs as agreed with special envoy Kofi Annan, even as a UN truce deadline loomed.

The foreign ministry's request came as a weekend escalation in violence claimed almost 180 lives, most of them civilians, ahead of the UN deadline of Tuesday for regime forces to cease fire.

The surge in bloodshed prompted harsh words from Annan who said the escalation was "unacceptable" while France denounced as "unacceptable" Syria's demand for guarantees.

Monitors said 51 people were killed on Sunday, a day after nearly 130 died across Syria, while 200 others were arrested in raids by government forces pushing to crush dissent.

"To say that Syria will pull back its forces from towns on April 10 is inaccurate, Kofi Annan having not yet presented written guarantees on the acceptance by armed terrorist groups of a halt to all violence," the foreign ministry said in a statement.

On Thursday, the UN Security Council formally endorsed the deadline, but Damascus said a day later that the number of "terrorist acts" has risen since the deal was agreed with the UN and Arab League envoy.

"Mr Annan has not submitted written guarantees from the governments of Qatar, Saudi Arabia and Turkey on stopping their funding to terrorist groups," the foreign ministry said of its key regional critics.

Annan's peace plan calls for the withdrawal of the Syrian army from protest cities on Tuesday, with a complete end to fighting 48 hours later.

"Syria is not going to repeat what happened in the presence of Arab observers when armed forces left towns," the foreign ministry said, referring to a failed Arab monitoring mission at the turn of the year.

Annan "said he would work to stop the violence, disarm armed groups... initiate a comprehensive national dialogue with opposition movements," when he met President Bashar al-Assad last month, the ministry said.

"It is this principle on which Syria accepted Annan's mission and his six-point plan."

Reacting to the challenge from the regime, the chief of the Free Syrian Army, which is made up mostly of deserters from the military, said his rebel fighters will respect the peace plan.

"We are committed to the Annan plan," Colonel Riyadh al-Asaad told AFP in Beirut by telephone. "We will present our guarantees and our commitments to the international community, but not to this (Syrian) regime."

France denounced as "unacceptable" the fresh Syrian demands in a strongly worded foreign ministry statement.

Assad had already accepted the terms of international envoy Kofi Annan's peace plan, it said.

The statement condemned what it called the "continuing massacres" and renewed French support for Annan.

In a statement in Geneva, Annan expressed "shock" at the surge in violence, calling the bloodshed "unacceptable" and urging the government in Damascus to respect its commitments.

"I remind the Syrian government of the need for full implementation of its commitments and stress that the present escalation of violence is unacceptable."

"This is a time when we must all urgently work towards a full cessation of hostilities, providing the space for humanitarian access and creating the conditions for a political process," Annan said.

The former UN chief said he was in "constant contact" with the government, and asked "all states with influence on the parties to use it now to ensure an end to the bloodshed and the beginning of dialogue."

Syrian Foreign Minister Walid Muallem is scheduled to travel to ally Moscow on Monday.

The United Nations says more than 9,000 people have been killed since anti-regime protests broke out in March 2011, while monitors put the number at more than 10,000.

The main umbrella opposition group the Syrian National Council called for UN intervention after monitoring groups said 86 of nearly 130 people killed on Saturday were civilians.

"We urge the UN Security Council to intervene urgently to stop the humanitarian crisis caused by the regime ... by adopting a resolution under Chapter 7 to ensure the protection of civilians," the SNC said.

Another 26 civilians, 17 soldiers and eight deserters were killed across the country on Sunday, monitors said.

Meanwhile the Syrian Observatory for Human Rights reported that deserters shot down a military helicopter in the northwest Idlib province, where fighting raged between rebels and army troops, quoting "several sources."

"The (unidentified) sources said they saw the aircraft exploding in the air before crashing," the Britain-based monitoring group said in a statement, adding that the incident was the first of its kind in the year-long conflict.

The incident, which could not be immediately confirmed by rebel or official sources, reportedly took place in the Jisr al-Shughur region of Idlib.

Belgium's Foreign Minister Didier Reynders said a humanitarian intervention under the protection of military forces could be the next stage if the Annan plan is not respected.

Pope Benedict XVI called in an Easter Day message for an end to the killings in Syria and a commitment to dialogue, as part of a wider appeal to give hope to the entire Middle East.

Students find success at Future Business Leaders competition ...

West Lincoln Future Business Leaders of America students.

AMANDA SEBASTIANO
Staff Writer

Improving their communication skills, learning how to present to an audience and getting an idea of what their lives will be like post-graduation, were just a few of the tools some of Lincoln County?s Future Business Leaders of America students studied recently ? skills they hope will help them stand out from their peers when looking for a job later.
?FBLA allows students to excel in all areas of business,? West Lincoln High School business teacher and FBLA coach Kelly Ann Somers told the Times-News. ?It builds confidence, team work, leadership skills and gives the students an edge over others applying for colleges and top-notch jobs.?
Lincolnton High and WLHS had students who competed at the State Leadership Conference in Greensboro March 22.
WLHS sent 11 of the 41-member FBLA team to the competition ? one of which won first place and was named North Carolina?s Future Business Leader, 16-year-old Megan Avery. Betsy Roland,17, and Matthew Schaffer,18, worked as a team and won second place with their business plan project, while others ranked in the top four and top 10. Avery, along with Roland and Shaffer, are moving onto the national competition in San Antonio in June; a costly trip that?s worth the experience, Somers said.
Somers and Jennifer Welch, who oversee West Lincoln?s team, are estimating the flight, hotel and registration fees to total about $3,000 for all three students to go on the trip. So far, the group has been trying to raise money through local fundraising events, like their Powder Puff football game.
Those in the club are learning techniques to use on their job search, such as interviewing tips, resume-building and job application skills.
Those a part of FBLA also participate in community service activities, such as the WLHS group who bought gifts for local, under-privileged children last Christmas and donated to the House of Hope, a counseling center for girls ages 12-17.
Down the road, LHS students reflect on their experiences at states and how the club will help them later in life. Their FBLA team was age and experience-diverse.
Senior and FBLA President Zachary Fitzgerald has participated in state conferences all four years of high school and is excited to use his new-found knowledge he gained through the group when he goes to college and eventually picks a career.
Freshman Andrew Cromer, however, is just getting warmed up. Cromer ranked in the top 10 for Word Processing at his first competition ? an amazing accomplishment, said Jennifer Luper, FBLA coach and career and technical department chair at Lincolnton High.
Senior Dylan Houser was the third member of the LHS club to travel to Greensboro, and took away some insight after his first time competing at the state level.
Luper and the her FBLA trio thought the session about learning to buy a car was one of the most practical sections of the trip and most enjoyable. Students were shown what type of questions to ask when deciding to get a loan for a car at the bank and what factors are important to consider.
?Even if you end up deciding not to pursue a career in business, you are still learning valuable leadership and life skills,? Houser said. ?We learned how to apply technology skills to every-day life.?

Three Lincolnton High School FBLA students also competed in Greensboro.

Health insurance and broccoli: A mismatched comparison

Recently, the U.S. Supreme Court heard arguments for and against the 2010 Affordable Health Care Act. Justice Antonin Scalia, a skeptic of the health insurance mandate in the law, raised the question to the government attorney, Donald Verrilli, that if the government can mandate to buy health insurance, why can't it mandate to buy broccoli?

The question implied that broccoli is good for a healthy diet and hence good for healthy outcomes; hence if the federal government is allowed to mandate buying of health insurance, it can overreach by mandating consumption of food products like broccoli.

Let me examine Justice Scalia's broccoli example and compare the mandate for broccoli consumption with the mandate to buy health insurance.

First, health insurance is not the same type of product as broccoli or cabbage or cauliflower. If a person does not consume broccoli, he has many close substitutes to improve his health.

In addition, if an individual does not consume broccoli he will not get sick and die. However, if a person does not have health insurance and faces serious illness or injury, he may face the choice between not seeking medical care and suffer debilitating health consequences or even death, or showing up in an emergency clinic for medical care. The 1986 law (Emergency Medical Treatment and Active Labor Act) mandates that emergency clinics provide medical care to all who show up. I wonder why Justice Scalia and some other justices are skeptical about a health insurance mandate on buyers but have not raised any questions about the mandate on the suppliers of emergency medical care.

Second, health insurance insures against risk due to the randomness of illness or injury. Most risk-averse people buy health insurance. However, many others who are young, healthy and are willing to take more risk may prefer to free-ride on insured persons. The uninsured are passing part of the cost of risk on to insured people, knowing that they can depend upon emergency clinics. In fact, those who are uninsured may engage in more risky behavior and hence consume more emergency medical care because they have reduced the cost of risk by passing it to others. On the other hand, higher premiums will lead to under-consumption (less than optimum) of medical care by the insured.

Mandating broccoli consumption, or even a healthy diet and lifestyle, will not insure against random illness and injury. Hence, given the mandate in 1986 law, mandating broccoli consumption is inconsequential in its effect on cost of medical-care providers and hence others' insurance premiums.

Third, the insurance system works when the pool of insured consists of people with varied health status. The diversified pool of healthy and relatively sick people keeps the premiums low, since premiums are affected by average risk. However, if the insurance pool consists only of sick people, the price of insurance will skyrocket and hence will drive most people out of the insurance market. This adverse selection problem causes market failure, where insurance providers may not survive due to losses or if they do survive, the premiums may be so high that many people may not be able to afford insurance or many with pre-existing health conditions may not be able to get insurance.

Broccoli market does not face adverse selection problem. There is no need of a pool of consumers -- healthy and sick -- to lower the price of broccoli. Mandating health insurance with penalties (or user charge for risk) forces all, especially healthy and young people, to join the insurance pool to lower the premiums based on average risk of the pool.

Fourth, health insurance, as opposed to broccoli consumption, enables a person or household to use a variety of medical services, including drugs, in case of illness or injury. An uninsured broccoli consumer who shows up in the emergency clinic will not be able to get the most efficient combination of medical services and drugs to treat illness or injury. Therefore, quality of health outcome will suffer and cost will rise over a period of time due the increased frequency of use of emergency clinics by uninsured broccoli consumers.

Fifth, given the mandate to emergency clinics in the 1986 law and the fact that insurance companies cannot refuse to provide insurance based on preexisting health status, according to the Affordable Care Act of 2010, mandating health insurance for all Americans is a least-cost strategy to deal with 30 million uninsured. This policy, with guidelines provided by the FDA for healthy diet and lifestyle, will go a long way in solving the escalating cost of medical care, which is expected to rise from a little more than 17 percent in 2010 to 26 percent of the Gross Domestic Product in 2035.

I hope the Justices of the U.S. Supreme Court are familiar with distinctive features of the health insurance market and broccoli market and are not persuaded by arguments advanced by ideologues and constitutionally challenged people.

Third Annual Empire State Legal Writing Conference

Registration is now open.? Here are the details:

The conference will be held all day on Saturday, June 23, 2012, at SUNY Buffalo Law School in Buffalo, New York. In conjunction with the conference, there will be a half-day ALWD Scholars? Forum on Friday, June 22.

?

There is no fee for the conference or the Scholars? Forum, and we?ve arranged a conference rate at two hotels near the law school. You can find further details and register for the conference at the conference web site: www.law.buffalo.edu/empirestate2012

?

We?re particularly excited about this year?s conference for three reasons.

?

First, we once again have a terrific program. The conference will feature more than 20 presentations on a wide range of topics, including: implementing learning outcomes and assessment, conducting student-led conferences, teaching continuity and structure, developing advanced writing courses and specialized research courses, teaching visual persuasion, developing and placing scholarship, and teaching writing skills actually used in practice. And many of the presentations involve classroom-ready teaching exercises, including plain language skills, research skills, using local rules, and legislative advocacy.

?

Second, we?re delighted to have Sarah Ricks from Rutgers School of Law ? Camden as our keynote speaker. Sarah will address the overlap between legal writing programs and ?experiential? learning (such as hybrid clinical/writing courses), as well as collaboration between legal writing faculty and professors who teach in clinical, pro bono, and externship programs.

?

And third, we?re pleased to offer an optional trip to Niagara Falls the day after the conference on Sunday, June 24. (There will be a small fee for the trip.)

June is a wonderful time to visit Buffalo, and if you have an extra day or two there are many other fun things you can do, such as touring a Frank Lloyd Wright house (the Darwin Martin house), visiting one of the country?s best modern art museums (the Albright-Knox), or watching a play at the Shaw Festival in Niagara-on-the-Lake, Ontario.

?

We hope that you?ll join us in June. If you have any questions, feel free to contact me.

We've Been Treating the Deadliest Form of Breast Cancer All Wrong [Cancer]

One of the worst things you can hear from you doctor is that you, or a loved one, has "triple negative" breast cancer. It stubbornly refuses to respond to the best treatments available, so doctors have to resort to chemotherapy. It strikes 16 percent of breast cancer patients, most of them younger than 40. But we may finally have figured out how to beat it. More »
