Check Your Ego At the Door ? Sales Coach AZ

No one is perfect, and growth is stunted by pride, so set your pride aside.

A company sales position requires more reflection and focus on self-improvement than any other position.? The market changes constantly and so must sales people, however, like most people, we are all apprehensive towards change, especially when we have been successful in the past.

We try to believe that what created success today, will create success tomorrow.? What got you to the top before may not get you there in the future.? Besides I don?t like to think of it as change; it?s about improving. I was just reading John C. Maxwell?s Self Improvement 101 and it reminded me that it?s not about change; it?s a way to improve.

Plan 1: Focus on self-development and not self-fulfillment.? Reaching your sales goal is self-fulfilling.? Has it really improved your sales skills?? Have you reached your sales potential, if not, what will you do to get there?

Plan 2: ?Reach your potential by having the mindset of a continual learner.? This is one of the first characteristics I look for when hiring a sales person.? What books have you read about your profession?? What seminars or workshops have you attended?? No matter how many years you have sold you can always learn something new.

Plan 3: Take time to read, listen or reflect. Self-Improvement must be planned for; the same way you develop a business plan.? Make an appointment with yourself every day or every week to take time to read about your profession, listen to webinars, or reflect on what good and bad things happened during the week, and what can be improved.? Bullet- point your weekly activities, and then bullet point lessons learned.? If you learned nothing, you?re doing something wrong.

A great way to improve yourself is to teach your peers something you?re learning. Conversely, you can learn a lot from your peers, even if you do not think they are as proficient as you.? I will never forget my younger brother, a high school All-American wrestler, asking for my advice about wrestling.? He not only asked me, he asked everyone.? ?He could learn something from anyone, younger or older.

Do you have a mentor or coach that can help you improve??

Nobody likes to be criticized, and many of us love sales, because we like to be our own boss.? However, we all need some coaching and/or mentoring. All the great golfers have coaches because they cannot see everything themselves.

Aren?t we the same??

(AP) ? Chan Gailey was fired by the Buffalo Bills after three losing seasons.

The announcement came Monday, a day after the Bills closed out another disappointing season with a 28-9 win over the New York Jets.

Buffalo finished 6-10, and Gailey leaves with a 16-32 record. There was no immediate word on the status of general manager Buddy Nix.

In a hopeful season after signing star defensive end Mario Williams to a $100 million contract, the Bills reverted to their ways of the past, failing to make the playoffs for a 13th straight year, the NFL's longest active drought.

Gailey met with his players during the team's annual exit meetings and informed at least one of his players that he expected to be fired.

Gailey addressed reporters for a little over a minute, and declined to take questions.

He thanked both Nix and team owner Ralph Wilson for the opportunity, and said he understood the reasons behind the decision. Gailey also announced that his entire staff had been fired.

"I understand this is a business. We didn't get the job done," Gailey said, reading from a Bills pad on which he had jotted down a few notes. "I've been called two other times to get things turned around, was able to do it. We weren't able to get this one done soon enough and I understand that completely."

Gailey's eyes then welled with tears when he credited Bills fans for their loyalty, and Buffalo for being a passionate football city.

"I think that the next staff will have a great opportunity for success, and make this another great football franchise," Gailey said. "This will probably be, and I say probably, but I think it will be the first place that's ever fired me that I'll pull for."

Gailey had at least one more season left on his contract.

It's the latest twirl of the coaching carousel in Buffalo.

The Bills are on their fifth coaching search since Wade Phillips was fired following the 2001 season. Phillips, who took over in 1998 after Hall of Famer Marv Levy retired, was the last coach to get the Bills to the playoffs. That was in the 1999 season, when Buffalo lost the AFC wild-card playoff to Tennessee on a last-second kickoff return, the "Music City Miracle."

Gailey took over in January 2010 after a tumultuous season in which Dick Jauron was fired in November, leaving defensive coordinator Perry Fewell to finish out the season on an interim basis.

It's unclear whether Nix will be overseeing the next coaching search. Nix was at the Bills' facility on Monday.

This was Gailey's second NFL head coaching job. He went a combined 18-16 in two seasons at Dallas before being fired following the 1999 season despite leading the Cowboys to the playoffs each year. He spent six years as head coach at Georgia Tech, where he had a 44-32 record before being fired after the 2007 season.

With 2013 around the corner, the California Department of Motor Vehicles (DMV) reminds motorists of several new laws that will ring in the New Year.

Among the new laws that take effect in January is AB 2020, which deletes the option for persons alleged to be driving under the influence of drugs to choose a chemical test of their urine for the purpose of determining drug impairment, with certain exceptions.

Other new laws will establish a new license plate, protect car buyers from buy-herepay- here car dealers in purchase transactions, establish safety standards for autonomous vehicles and impose a new fee on vessel owners.

The following is a listing of selected motor vehicle and driver-related laws that will take effect on January 1, 2013.

---- Driving Under the Influence.
Drivers suspected of driving under the influence of drugs will no longer have the option to choose a chemical test of their urine to determine drug content. By requiring a blood test, with a few exceptions, AB 2020 will help law enforcement and prosecutors to better identify and convict persons driving under the influence of drugs. If a blood test is unavailable, then the person is deemed to have given his or her consent to a urine test. (AB 2020/Pan)

---- California Legacy License Plates.
Effective January 1, 2013, DMV will accept applications for a series of three specialized license plates that replicate plates from California's past. Motorists

will be able to choose from a minimum of three styles: yellow background with black lettering, black background with yellow lettering, and blue background with yellow lettering. (AB 1658/Gatto)

---- Buy-Here-Pay-Here Car Dealers.
Two new laws are directed at used car dealers that assign less than 90 percent of their conditional sales and lease contracts to third party lenders; and therefore provide direct financing to car buyers. One of the new laws defines these used car dealers as buy-here-pay-here dealers.

AB 1447 further prohibits these dealers from requiring buyers to make payments in person, except for the down payment, and limits the circumstances under which buy-herepay- here dealers may track a vehicle using electronic tracking technology (GPS tracking). Buy-here-payhere used car dealers will not be allowed to disable a vehicle with starter interrupt technology without first notifying the buyer in writing at the time of sale.

In addition, buy-here-pay here used car dealers will be required to provide a 30- day or 1,000 mile warranty as part of any purchase or lease of a used vehicle. (AB 1447/Feuer)

AB 1534 requires buy-here- pay-here used car dealers to affix and prominently display a label on any used vehicle offered for retail sale that provides the reasonable market value of the vehicle. The label must contain specific information from a recognized pricing guide used to determine that value and the date the value was determined.

The prospective purchaser must also be provided with a copy of the information that the dealer used to determine the vehicle's value. (AB 1534/Wieckowski)

---- Traffic Violator School.
AB 1888 will allow commercial drivers to attend traffic violator school (TVS) for violations that take place when operating non-commercial vehicles. The conviction would not count as a point for determining whether a driver is presumed to be a negligent operator unless it was considered a serious violation. The record of the conviction would not be held confidential and would be disclosed to employers, and to insurers for insurance underwriting and rating purposes. (AB 1888/Gatto)

---- Veteran License Plates.
An increase in fees for the issuance, renewal, and personalization of veterans' organizations license plates will benefit the County Veterans Service Officers Fund. The fund is used by local agencies to assist veterans and their families in obtaining benefits and services accrued through military service.

This new law also clarifies the plate's availability to veterans and non-veterans, requires DMV to make decals available for the plate that indicate an applicant's service in a particular war or armed conflict and decals honoring veterans of a particular war or conflict.

Additionally, the law will require DMV to make available a yellow ribbon/support our troops decal to be issued in lieu of the above-described service decals. (AB 1550/Bonilla)

---- Autonomous Vehicles.
This new law allows for testing of autonomous vehicles, or self-driving cars, by designees of an autonomous technology manufacturer, provided certain requirements are met. Prior to the public operating autonomous vehicles, a manufacturer is required to submit an application to DMV, and certify that specified insurance, vehicle safety, and testing standards have been met.

The legislation authorizes regulations to specify any additional requirements deemed necessary by DMV, such as limitations on the number of autonomous vehicles deployed on the states highways, special vehicle registration and driver licensing requirements, and rules for the suspension, revocation, or denial of any license or approval issued by DMV pertaining to autonomous vehicles. ---- Vessel Registration Fees.
An increase in vessel registration fees, as yet to be determined by the Department of Boating and Waterways, will be collected by DMV to fund the implementation and administration of dreissenid mussel monitoring, inspection, and infestation prevention programs in California waterways.

The fee may not exceed ten dollars and will not be imposed on vessels operated exclusively in marine waters. (AB 2443/Williams)

'Do something!' Americans fed up with D.C. over 'cliff'

Americans from across the country express their frustration with lawmakers in Washington who have yet to reach an agreement on averting looming tax increases.

Tennessee Sen. Bob Corker said Friday that ?the American people should be disgusted? the nation?s leaders haven?t been able to avert the fiscal cliff.

Across the country, people are shaking their heads about negotiations that go nowhere and fingers that point everywhere while the nation hurtles toward the precipice of a new economic crisis.

?They should make a plan, make up their minds and do something!? Abigail Holt of Hartford, Conn., told NBC News.

She?s 17 years old and admits she?s just learning about the federal government and the fiscal cliff. But she knows this much: ?It?s annoying.?

And that's being polite.

Writing in the Daily Beast, Howard Kurtz called the nation's capital "the country?s biggest day-care center." The famous sex therapist Dr. Ruth Westheimer hit below the belt, noting on Twitter that "Members of Congress who can't compromise probably aren't good lovers."

Californian Pat Marshall said the politicians "appear to be very self-centered on making sure that they?re taken care of and the American public comes second."

After an hourlong meeting Friday with congressional leaders that he described as "constructive," President Obama acknowledged that people outside Washington were bewildered by D.C. "dysfunction" and that time -- and patience -- were running out.

Lawmakers have 'lost touch'
Indeed, with higher taxes and deep spending cuts looming without a deal, Americans? faith in Washington is dissipating by the day.

A Dec. 9 Gallup poll found that 59 percent thought it was likely the White House and Congress could hammer out a deal to avoid a slide down the cliff; by this week, that had sunk to 50 percent.

Skeptics were gaining ground, meanwhile: 48 percent think an agreement before the year-end deadline is unlikely, up 10 points from two weeks earlier.

?It doesn?t feel like they?re doing much,? said Rich Dodds, 49, an energy product manager from Houston, Texas. ?I think they?ve lost touch with who the American people are. It?s a pretty elite group in Washington.?

The fact that both houses of Congress went into recess -- the Senate took a nearly week-long break, and the House is still on vacation until Sunday -- bothered some.

?This is one of the most important issues and they are not even working,? said Bill Prosser, 49, a telecommunications salesman from Clifton, Va. ?I?m very disappointed in them.?

Nicole Hayward, 28, of Brooklyn, N.Y., was so angered by the congressional recess that she posted a petition on Change.org demanding lawmakers get back to business.

?I turn on the news every day while I?m getting ready for work and I saw coverage about how Congress was going to break for the holidays and we might not have a resolution,? the marketing director said. ?I thought, who cares about their holiday vacation? It really got me going.?

Hayward got only 101 signatures on her petition. She attributed the lack of interest to cynicism.

?The reason why the average American doesn?t pay attention to this issue and the details is they think Congress will come together and pass something that just kicks the can down the road and things won?t change in [their] life,? she said.

Bipartisan blame
Inside the Beltway, Democrats are condemning Republicans and vice versa for the stalemate. But the nation?s voters are more bipartisan in their blame, with neither Republicans nor Democrats obtaining majority support.

?Essentially, right now, 25 percent of the public approves of the job the GOP congressional leaders are doing and 40 percent approves of the job the Democratic leaders are doing,? said Jocelyn Kiley, a senior researcher for the Pew Research Center for the People & the Press.

Prosser thinks there?s a time-tested way to bring the two sides together before Jan. 1 -- something akin to the old papal conclaves in which cardinals were locked in a room until they chose a new pontiff.

?Just say you?re not going to leave until you have a deal,? Prosser said.? ?Get in a room -- and get it done!?

In the Eye of the Tornado

When Tom Boonen crossed the finish line, alone, inside the hallowed velodrome of Paris-Roubaix, he?d done much more than just win the sport?s most demanding classic.

By winning Roubaix one week after he?d won the Tour of Flanders ? and two weeks after winning both E3 Harelbeke and Ghent-Wevelgem ? the Omega Pharma-Quick Step rider had silenced his critics, once and for all, proving to the world, and to himself, that he is the best cobblestones racer of his era, and perhaps of all time.

Unlike his sprint wins at Flanders, Ghent-Wevelgem and Harelbeke, Boonen won Roubaix in dramatic style, attacking with 55km remaining and holding off all of the sport?s toughest racers save for one ? Fabian Cancellara (RadioShack-Nissan), Boonen?s long-running classics rival ? who was watching the race at home in Switzerland while nursing a surgically repaired collarbone.

With his victory, Boonen had tied Roger De Vlaeminck?s record of four Paris-Roubaix wins; he?d also become the only rider to accomplish the extraordinary Flanders-Roubaix double more than once.

But more important than any record, Boonen had come full circle. He?d closed the door on the endless question marks, implications and innuendo that suggested he?d fallen permanently from grace. He?d proven that he had not, in fact, squandered his talent, and he had not sold short the limitless career that lay before him after his breakthrough 2005 season ? a career that has been hindered by obstacles, both external and self-imposed.

#NARRATIVEFAIL: California gun sales jump; gun injuries, deaths fall. ?Gun deaths and injuries have dropped sharply in California, even as the number of guns sold in the state has risen, according to new state data. Dealers sold 600,000 guns in California last year, up from 350,000 in 2002, according to records of sale tallied by the California Attorney General?s office. During that same period, the number of California hospitalizations due to gun injuries declined from about 4,000 annually to 2,800, a roughly 25 percent drop, according to hospital records collected by the California Department of Public Health. Firearm-related deaths fell from about 3,200 annually to about 2,800, an 11 percent drop, state health figures show.?

(AP) ? Senate leaders groped for a last-minute compromise Saturday to avoid middle-class tax increases and possibly prevent deep spending cuts at the dawn of the new year as President Barack Obama warned that failure could mean a "self-inflicted wound to the economy."

Obama chastised lawmakers in his weekly radio and Internet address for waiting until the last minute to try and avoid a "fiscal cliff," yet said there was still time for an agreement. "We cannot let Washington politics get in the way of America's progress," he said as the hurry-up negotiations unfolded.

Senate Republicans said they were ready to compromise. "Divided government is a good time to solve hard problems_and in the next few days, leaders in Washington have an important responsibility to work together and do just that," said Sen. Roy Blunt of Missouri, delivering his party's weekly address.

Even so, there was no guarantee of success.

In a blunt challenge to Republicans, Obama said that barring a bipartisan agreement, he expected both houses to vote on his own proposal to block tax increases on all but the wealthy and simultaneously preserve expiring unemployment benefits.

Political calculations mattered as much as deep-seated differences over the issues, as divided government struggled with its first big challenge since the November elections.

Speaker John Boehner remained at arms-length, juggling a desire to avoid the fiscal cliff with his goal of winning another new term as speaker when a new Congress convenes next Thursday. Any compromise legislation is certain to include higher tax rates on the wealthy, and the House GOP rank and file rejected the idea when Boehner presented it as part of a final attempt to strike a more sweeping agreement with Obama.

Yet lawmakers have until the new Congress convenes to pass any compromise, and even the calendar mattered. Democrats said they had been told House Republicans might reject a deal until after Jan. 1, to avoid a vote to raise taxes before they had technically gone up and then vote to cut taxes after they had risen.

Nor was any taxpayer likely to feel any adverse impact if legislation is signed and passed into law in the first two or three days of 2013 instead of the final hours of 2012.

Gone was the talk of a grand bargain of spending cuts and additional tax revenue in which the two parties would agree to slash deficits by trillions of dollars over a decade.

Now negotiators had a more cramped goal of preventing additional damage to the economy in the form of higher taxes across the board ? with some families facing increases measured in the thousands of dollars ? as well as cuts aimed at the Pentagon and hundreds of domestic programs.

Republicans said they were willing to bow to Obama's call for higher taxes on the wealthy as part of a deal to prevent them from rising on those less well-off.

Democrats said Obama was sticking to his campaign call for tax increases above $250,000 in annual income, even though he said in recent negotiations he said he could accept $400,000.

There were indications from Republicans that estate taxes might hold more significance for them than the possibility of higher rates on income.

Jon Kyl of Arizona, said late Friday he was "totally dead set" against Obama's estate tax proposal, and as if to reinforce the point, Blunt mentioned the issue before any other in his broadcast remarks. "Small businesses and farm families don't know how to deal with the unfair death tax_a tax that the president and congressional leaders have threatened to expand to include even more family farms and even more small businesses," he said.

Officials said any compromise was likely to ease the impact of the alternative minimum tax, originally designed to make sure that millionaires did not escape taxation. If left unchanged, it could hit an estimated 28 million households for the first time in 2013, with an average increase of more than $3,000.

Taxes on dividends and capital gains are also involved in the talks, as well as a series of breaks for businesses and others due to expire at the first of the year.

Obama and congressional Democrats are insisting on an extension of long-term unemployment benefits that are expiring for about 2 million jobless individuals.

Leaders in both parties also hope to prevent a 27 percent fee cut from taking effect on Jan. 1 for doctors who treat Medicare patients.

There was also discussion of a short-term extension of expiring farm programs, in part to prevent a spike in milk prices at the first of the year. It wasn't clear if that was a parallel effort to the cliff talks or had become wrapped into them.

Across-the-board spending cuts that comprise part of the cliff were a different matter.

Republicans say Boehner will insist that they will begin to take effect unless negotiators agreed to offset them with specified savings elsewhere.

That would set the stage for the next round of brinkmanship ? a struggle over Republican calls for savings from Medicare, Medicaid and other federal benefit programs.

The Treasury's ability to borrow is expected to expire in late winter or early spring, and without an increase in the $16.4 trillion limit, the government would face its first-ever default. Republicans have said they will use administration requests for an extension as leverage to win cuts in spending.

Ironically, it was just such a maneuver more than a year ago that set the stage for the current crisis talks over the fiscal cliff.

WASHINGTON (AP) -- The end game at hand, the White House and Senate leaders took a final stab at compromise Friday night to prevent middle-class tax increases from taking effect at the turn of the new year and possibly prevent sweeping spending cuts as well.

"I'm optimistic we may still be able to reach an agreement that can pass both houses in time," President Barack Obama said at the White House after meeting for more than an hour with congressional leaders.

Surprisingly, after weeks of postelection gridlock, Senate leaders sounded even more bullish.

The Republican leader, Sen. Mitch McConnell of Kentucky, said he was "hopeful and optimistic" of a deal, adding he hoped a compromise could be presented to rank-and-file lawmakers as early as Sunday, a little more than 24 hours before the year-end deadline.

Said Majority Leader Harry Reid: "I'm going to do everything I can" to prevent the tax increases and spending cuts that threaten to send the economy into recession. He cautioned, "Whatever we come up with is going to be imperfect."

Officials said there was a general understanding that any agreement would block scheduled income tax increases for middle class earners while letting rates rise at upper income levels.

Democrats said Obama was sticking to his campaign call for increases above $250,000 in annual income, even though in recent negotiations he said he could accept $400,000.

The two sides also confronted a divide over estate taxes.

Obama favors a higher tax than is currently in effect, but one senior Republican, Sen. Jon Kyl of Arizona, said he's "totally dead set" against it. Speaking of fellow GOP lawmakers, he said they harbor more opposition to an increase in the estate tax than to letting taxes on income and investments rise at upper levels.

Also likely to be included in the negotiations are taxes on dividends and capital gains, both of which are scheduled to rise with the new year. Also the alternative minimum tax, which, if left unchanged, could hit millions of middle- and upper-income taxpayers for the first time.

In addition, Obama and Democrats want to prevent the expiration of unemployment benefits for the long-term jobless, and there is widespread sentiment in both parties to shelter doctors from a cut in Medicare fees.

The White House has shown increased concern about a possible spike in milk prices if a farm bill is not passed in the next few days, although it is not clear whether that issue, too, might be included in the talks.

One Republican who was briefed on the White House meeting said Boehner made it clear he would leave in place spending cuts scheduled to take effect unless alternative savings were found to offset them. If he prevails, that would defer politically difficult decisions on government benefit programs like Medicare until 2013.

Success was far from guaranteed in an atmosphere of political mistrust ? even on a slimmed-down deal that postponed hard decisions about spending cuts into 2013 ? in a Capitol where lawmakers grumbled about the likelihood of spending the new year holiday working.

In a brief appearance in the White House briefing room, Obama referred to "dysfunction in Washington," and said the American public is "not going to have any patience for a politically self-inflicted wound to our economy. Not right now."

If there is no compromise, he said he expects Reid to put legislation on the floor to prevent tax increases on the middle class and extend unemployment benefits ? an implicit challenge to Republicans to dare to vote against what polls show is popular.

The guest list for the White House meeting included Reid, McConnell, Boehner and House Democratic leader Nancy Pelosi, D-Calif.

The same group last met more than a month ago and emerged expressing optimism they could strike a deal that avoided the fiscal cliff. At that point, Boehner had already said he was willing to let tax revenues rise as part of an agreement, and the president and his Democratic allies said they were ready to accept spending cuts.

Since then, though, talks between Obama and Boehner faltered, the speaker struggled to control his rebellious rank and file, and Reid and McConnell sparred almost daily in speeches on the Senate floor. Through it all, Wall Street has paid close attention, and in the moments before the meeting, stocks were trading lower for the fifth day in a row.

The core issue is the same as it has been for more than a year, Obama's demand for tax rates to rise on upper incomes while remaining at current levels for most Americans. He made the proposal central to his successful campaign for re-election, when he said incomes above $200,000 for individuals and $250,000 for couples should rise to 39.6 percent from the current 35 percent.

Boehner refused for weeks to accept any rate increases, and simultaneously accused Obama of skimping on the spending cuts he would support as part of a balanced deal to reduce deficits, remove the threat of spending cuts and prevent the across-the-board tax cuts.

Last week, the Ohio Republican pivoted and presented a Plan B measure that would have let rates rise on million-dollar earners. That was well above Obama's latest offer, which called for a $400,000 threshold, but more than the speaker's rank and file were willing to accept.

Facing defeat, Boehner scrapped plans for a vote, leaving the economy on track for the cliff that political leaders in both parties had said they could avoid. In the aftermath, Democrats said they doubted any compromise was possible until Boehner has been elected to a second term as speaker when the new Congress convenes on Jan. 3.

Further compounding the year-end maneuvering, there are warnings that the price of milk could virtually double beginning next year.

Congressional officials said that under current law, the federal government is obligated to maintain prices so that fluid milk sells for about $20 per hundredweight. If the law lapses, the Department of Agriculture would be required to maintain a price closer to $36 of $38 per hundredweight, they said. It is unclear when price increases might be felt by consumers.

Judge approves Toyota's settlement

SAN FRANCISCO --?A U.S. judge granted preliminary approval on Friday to Toyota Motor Corp's $1.1 billion settlement of a class-action lawsuit brought by consumers who lost value on their cars due to sudden, unintended acceleration.

U.S. District Judge James Selna in Santa Ana, California, scheduled a hearing in June for final approval of the deal, which was announced this week. It provides $500 million in cash for plaintiffs, plus installation of break override systems and a customer support program valued at about $600 million combined.

"Settlement will likely serve the interests of the class members better than litigation," Selna wrote.

Plaintiff lawyer Steve Berman said he was pleased with the favorable comments in Selna's order. Toyota spokeswoman Julie Hamp said the company was gratified by Selna's approval of the settlement, "which will provide value to our customers and provides an extra measure of confidence in their vehicles."

About 16 million Toyota, Lexus and Scion vehicles sold in the United States spanning the model years 1998 to 2010 are covered by the settlement. Company officials have maintained that the electronic throttle control system was not at fault, instead blaming ill-fitting floor mats and sticky gas pedals.

A study by federal safety officials at the National Highway Traffic Safety Administration and NASA found no link between reports of unintended acceleration and Toyota's electronic throttle control system.

Toyota, the No. 3 automaker in the U.S. market, admitted no fault in proposing the settlement, one of the largest U.S. mass class-action litigations in the automotive sector. One plaintiff's law firm called it the largest settlement in U.S. history involving auto defects.

However, the deal does not cover wrongful death or injury lawsuits, believed to total more than 300 according to a Toyota filing in June.

Toyota's recall of its vehicles between 2009 and 2011 relating to the unintended acceleration issue hurt its reputation for reliability and safety.

But the automaker's sales were up almost 29 percent in 2012 through November, compared with a 14 percent increase in the industry, and Toyota's share of the U.S. market has risen to 14.4 percent from 12.7 percent in 2011.

In his order on Friday, Selna said the settlement is fair, given the risks of further litigation and the complicated legal rulings he has issued throughout the case.

"Some of these rulings have been favorable to plaintiffs, some have been favorable to Toyota," Selna wrote. "Were the parties to proceed to a fully litigated result, virtually any outcome would face the risk of uncertainty upon appellate review of these rulings."

Selna also approved up to $200 million in attorneys' fees, saying the amount falls within 25 percent of the total settlement which is the benchmark established by appellate law.

(AP) ? Former President George H.W. Bush remained in intensive care at a Houston hospital on Friday but his condition continues to improve, a spokesman said.

"The President is alert and, as always, in good spirits ? and his exchanges with doctors and nurses now include singing," family spokesman Jim McGrath said in a brief statement.

The 88-year-old Bush, the nation's oldest living former president, was admitted at Methodist Hospital in Houston on Nov. 23 because of a bronchitis-related cough, after spending about a week there earlier in November for the same condition.

The cough was mostly resolved by the time he was moved to intensive care on Sunday for treatment of a fever that doctors were having difficulty controlling.

"The Bushes thank everyone for their prayers and good wishes and, like their doctors, are cautiously optimistic that the current course of treatment will be effective," McGrath said.

On Thursday, a longtime Bush aide tried to quell concern about Bush's condition by saying the former president likely would advise well-wishers to "put the harps back in the closet."

Jean Becker, Bush's Houston chief of staff, said the former president would likely be in the hospital for a while, noting his age and that "he had a terrible?case of bronchitis which then triggered a series of complications."

Becker said "most of the civilized world" contacted her after word spread that Bush had been placed in intensive care unit.

"Someday President George H.W. Bush might realize how beloved he is, but of course one of the reasons why he is so beloved is because he has no idea," Becker said in the at-times lighthearted statement that made multiple references to jokes and the former president's sense of humor.

Updates on his health are being limited out of respect for the family, she said.

The family had hoped Bush would have been well enough to spend Christmas at home. His cough eased, but he developed a persistent fever. His condition has since been downgraded to "guarded."

The former president has been visited by family and friends, including longtime friend James Baker III, his former Secretary of State. Bush's daughter, Dorothy, arrived Wednesday from her home in Bethesda, Md. Other visitors have included his sons George W. Bush, the 43rd president, and Jeb Bush, the former Florida governor.

Bush and his wife, Barbara, live in Houston during the winter and spend their summers at a home in Kennebunkport, Maine.

Bush, the 41st president, had served two terms as Ronald Reagan's vice president when he was elected in 1988. Four years later, after a term highlighted by the success of the 1991 Gulf War in Kuwait, he lost to Democrat Bill Clinton amid voters' concerns about the economy.

Bush was a naval aviator in World War II ? at one point the youngest in the Navy ? and was shot down over the Pacific. He's skydived on at least three of his birthdays since leaving the White House, most recently when he turned 85.

Bush, also a former U.S. ambassador to China and CIA director, suffers from a form of Parkinson's disease that forced him in recent years to use a motorized scooter or wheelchair for mobility.

    744: Current Operators And Planned Retirements ? Civil Aviation ...

    Sadly it seems that the 747-400s days are numbered with major operators planning to retire the type or already has retired it. However threre are still quite a few operators flying the 744. Here are some that I believe use the 744 on regular scheduled flights

    It would be great if we all could help out to fill this list with how many 744s each carrier has and when they plan to retire the type. This will give us 747-400 aficionados a good and complete list of where we can hop on a 744, and for how much longer.

    The KL has 26 744 aircraft in their fleet: 4x cargo, 17x combi and 5x full pax. The full pax models will be replaced by 77W aircraft while the combi's will be replaced by 787's and A350s'. However, it will take until 2020 at least before all 744 aircraft are gone.
    As far as I know, CX will retire their last 744 in 2016. Based on the CX Interim Results presentation for this year, they currently have 21 pax 744s, 4 of which are on operating leases, and the last of which will expire in 2016. I have heard that CX are accelerating plans for 744 retirement, but even assuming they retire all their owned pax 744s before 2016, it appears that they'll still be operating the leased aircraft until then.
    Just to specify, the list should only contain active 744s, none that are stored but still owned by the airline.

    Lufthansa is cuurently replacing its older 747-400 with A380s and 747-8Is. The newer 747-400s are planned to stay for a few years flying side by side with its newer siblings the 747-8I- With Lufthansa you have a chance to fly on the 747 for at least 20 more years ?
    Qantas has postponed some of the A380 deliveries and decided to refurbish 9 of the 18 744 aircraft, so they will stay in the fleet for a little bit longer. The last 747 aircraft should leave the fleet by 2021.
    Air New Zealand apparently still has 2 Boeing 747 400's in service. The type is said to be retired from their fleet in 2015.

    Air Pacific also still have 2 Boeing 747 400's. They will be retired from the fleet in 2013 apparently.

    All five PR 744s are still in service, although rumors are going around that they will be retired by 2017.
    Air India, Air New Zealand, Air Pacific, Air Pullmantur, Asiana Airlines, Corsair International, EVA Air, Garuda Indonesia, Lion Airlines, Malaysia Airlines, Philippine Airlines and Royal Air Maroc all also still operate them on scheduled services.

    They are nearly always scheduled to operate NZ7/NZ8 to and from San Francisco as well as several trans-Tasman flights. I think they also get send up to Vancouver every once in a while. Both were bought from the lessors by Air New Zealand a few years back.

    Well, things at LH change rather quickly. I was told when I was at flight school I will never fly the 737... That was in 2001... And they are still around.
    So the same for the 742 back then. So I guess we will see the 744 for many more years at LH as we have some rather new ones. The old ones will be retired pretty soon with the replacement 748's.

    I guess so. Isnt LH known for using aircraft until they reach the end of their serviceable lives? I know that at the time of retirement some of LH's 744s had the highest hours/cycles recorded on the type. I believe they hold a similar record for the 737s.

    Yes, LH uses their airplanes quite long. Good service makes it possbile. The oldest 744 which are retired had over 120,000 hours and were from 1988. So quite old, but still an incredible reliability ??

    DL has 16 744s and has just done a complete cabin refurbishment on them. Despite being some of the oldest 744's (NW took delivery of the first 744) AFAIK there are no plans to retire them.

    UA has 24 744's (23 mainline and 1 charter) UA announced some time ago that they intended on replacing them with the A350-900 however with the CO merger there is some talk of acquiring larger aircraft (350-1000, 737--300NG or 747-8i) to replace the 744's. They recently concentrated all of the 744s around SFO in order to improve dispatch reliability. UA finished retrofitting IPTE on the 744 a couple of years ago but is adding worldwide WiFi and streaming video to improve the experience in Y.

    CI has 13 744 in service and 18 744F, 3 744F in storage,and one leased out.
    Just announced order for 6 77W (with purchase rights for 4) and lease another 4. Seems to be a 744 replacement program though initially the first ones will replace A343 till A359 delivered. They just spent over 100 million Us$ refurbishing the 744 cabins. First 77W delivery from GECAS 2014 but not sure when first 744 retirements would be., first A359s due 2016.

    What they will do with their 744F fleet, the largest, is the 6 billion $ question for B! I don't see a for one for one replacement, they could do with something smaller for regional routes or even for the lower 48 states for transpac with transhipment via ANC etc, plus there is far more competition from newer carriers now. As most of their cargo business is electronics they probably would need the 7478F rather than a 777 F for the volume. With 24 A333s in service or due in next 2 years the A332F would fit well size wise as a smaller complement to the 747 and for commonality (except they would have to change engine suppliers as GE is not on the A332F).

    The last 4 pax 744s are operated by CI, they were delivered 04/05. Hoping they stay till end of this decade!
